A tenancy does not end automatically on death. It vests in the estate and rent continues to be payable, or it passes to a successor where a statutory or contractual right of succession applies — most commonly a spouse or partner living there as their only or principal home. Tell the landlord in writing promptly, and agree in writing how and when the tenancy will end.
This is one of the most expensive things to get wrong after a death, because rent accrues quietly while everyone deals with more urgent matters. The estate remains liable, and executors have found themselves paying months of rent on an empty flat because nobody served a notice.

- Tell the landlord or housing provider in writing straight away.Include the date of death and who is dealing with the estate. Keep a copy. A verbal conversation with a letting agent is not a record.
- Find out what type of tenancy it was.Social housing — council or housing association — has statutory succession rights. A private assured shorthold tenancy in England or Wales generally does not, beyond a limited statutory right for a spouse or partner in some older tenancy types, and Scotland's private residential tenancy and Northern Ireland's private tenancies each have their own succession rules. - Check whether anyone has a right to succeed.In social housing, a spouse, civil partner or partner living in the property as their only or principal home usually has a statutory right to succeed once, and some agreements extend it to other family members who have lived there for a qualifying period. The right is normally limited to one succession in total.
- Understand what happens with no successor.A periodic tenancy vests in the estate and continues until ended by notice. A fixed-term tenancy continues to its end date. Either way rent is payable from the estate in the meantime.
- Serve notice properly and agree a surrender if you can.The personal representative can normally serve notice to quit, but only once they have authority — which for larger estates may mean waiting for a grant. Most landlords will agree an early surrender by written agreement instead, which is faster and stops the rent. Get it in writing.
